The Senate and House of Representatives met in regular session this week working to move bills out of subcommittee and committee and onto the floor for debate. There are three legislative days left in the regular session of the General Assembly until adjournment on May 8.  

The House of Representatives amended the Senate amendments and sent H3309, the SC Energy Security Act, back to the Senate. The House also amended the Senate amendments to H3497, the liquor liability bill, and sent those amendments back to the Senate. Tort reform was not included in the House amendments to H3497.  

Since this is the first year of a two-year session, bills that don’t pass by Thursday at 5 p.m. remain in play for the 2026 session.  

Zero millage on the Senate calendar 
S102, the bill that allows a municipality without an operating millage to impose one with limitations, was approved by the Senate Finance Committee on Tuesday and given second reading by the Senate on Thursday. Next, the bill will be on the calendar for third reading.

Military Tax Increment Financing bill enrolled for ratification  
H3333, the military TIF bill, was passed by the House and Senate and enrolled for ratification. This bill includes affordable housing as an allowable project in a TIF district, extends the bonding period for projects in a military TIF, and gives local governing bodies greater flexibility when using TIF funds outside of the TIF boundary.

Committee Report

House Agriculture, Natural Resources and Environmental Affairs Committee 
S367 – abandoned vessels – favorable report. Later in the week, the full House of Representatives gave this bill a second reading with unanimous consent for third reading on the next legislative day.  
Summary of the bill as introduced: Declares abandoned, derelict or sunken vessels to be public nuisances. 
H4168 – Extension of water and sewer systems – adjourned debate 
Summary of the bill as introduced: Exempts certain properties from connecting to a municipal water or sewer system.  

 

House Ways and Means General Government subcommittee 
H3514 – purchasing flags – favorable report as amended. The amendment grandfathers existing supply to allow those that purchased flags in bulk to exhaust their current supply before the penalty begins. The next day the House Ways and Means Committee gave the bill a favorable report as amended by the subcommittee. Later in the week, the full House of Representatives gave this bill a second reading with unanimous consent for third reading on the next legislative day.  
Summary of the bill as introduced:  Prohibits state departments, agencies, institutions and political subdivisions from using public funds to purchase flags unless they are made in the United States.  

 

House Labor, Commerce and Industry Banking and Insurance subcommittee 
S210 – Captive insurance companies – favorable report as amended. The amendment updates definitions in the bill and adds a sentence regarding liquor liability. Later in the week, the full House Labor, Commerce and Industry Committee gave this bill a favorable report as amended. The full House of Representatives gave this bill second reading on Thursday with unanimous consent for third reading on the next legislative day. 
Summary of the bill as introduced: Outlines and provides definitions for foreign captive insurance companies.  

 

Senate Judiciary Committee 
H3571 – Underground facility damage prevention – favorable report as amended. The amendment revises the definition of large project and commencement date. Later in the week, the Senate gave this bill second reading. However, because there are still pending amendments, senators agreed to allow those amendments to be considered on third reading. 
Summary of the bill as introduced: Adds definitions for certain terms in the Underground Facility Damage Prevention Act and preempts local government ordinances that require pre-marking of facilities or permits to identify facilities.  

 

Senate Finance Committee 
S439 – Manufacturing property tax exemption – favorable report 
Summary of the bill as introduced: Increases the maximum reimbursement amount for the property tax exemption on certain manufacturing property. Later in the week, the Senate gave this bill second reading. 

 

Senate Labor, Commerce and Industry Committee 
S256 – C-PACE programs – favorable report as amended. The amendment updates nomenclature in the bill, changing the name of the bill from SC Commercial Property Assessed Clean Energy and Resilience Act, to the Commercial Property Assessed Capital Expenditure Improvement Act 
Summary of the bill as introduced: Enacts the South Carolina Commercial Property Assessed Clean Energy and Resilience Act to establish a process for assessing and collecting liens.  

 

Senate Transportation Committee 
H3292 – Golf cart operation – favorable report as amended. The amendment allows cities to regulate golf carts through an ordinance, while still providing for certain minimum state standards. 
Summary of the bill as introduced: Allows counties and municipalities to enact ordinances to allow golf carts to operate in designated areas at night. 

 

Senate Family and Veterans’ Services Child Welfare subcommittee 
S331 – Infant safe havens – favorable report 
Summary of the bill as introduced: Allows infant safe havens to use newborn safety devices in addition to employees of the safe haven. 

 

House Ways and Means Committee 
H4216 – income tax reduction – favorable report as amended. The amendment creates two income tax rates.  
Summary of the bill as introduced: Reduces the income tax rates for a flat 3.99% and sets standards for further reductions in the tax. 
H3876 – Accommodations taxes – favorable report as amended by the subcommittee. 
Summary of the bill as introduced: Adds the position of accommodations intermediary to facilitate the rental of accommodations. 
H3858 – Taxes on boats –favorable report as amended. The amendment lowers the property tax on boats to 6% and grandfathers in the counties that already lowered the boat tax to 6%. 
Summary of the bill as introduced: Exempts the property tax on boats by 50%.

House Judiciary Committee 
H4000 – Alcohol licensing for performing arts and convention complexes – favorable report as amended. The amendment added college sporting events and municipal amphitheaters with a 400-person minimum capacity to the bill. The full House of Representatives gave this bill second reading on Thursday with unanimous consent for third reading on the next legislative day. 
Summary of the bill as introduced: Adds performing arts and convention complexes owned by a municipality to the law that allows on-premises consumption of beer and wine. 
H3497 – liquor liability insurance – favorable report as amended. The amendment includes only liquor liability and joint and several liability language to the bill. This bill was originally passed by the House and amended by the Senate. The Senate added their version of liquor liability insurance reform and tort reform to the bill. The House Judiciary Committee  amended the bill to only include liquor liability and joint and several liability provisions.
Summary of the bill as introduced: Allows a captive insurance company to provide liquor liability insurance and provides for alcohol serving training requirements.  

 

House Labor, Commerce and Industry Committee  
S171 – Waste tire disposal fees – favorable report. Later in the week, the full House of Representatives gave this bill second reading with unanimous consent for third reading on the next legislative day. 
Summary of the bill as introduced: Allows a county to charge up to $400 per tire as a tipping fee for waste tire disposal.  
S275 – Electric vehicle charging stations – favorable report. Later in the week, the full House of Representatives gave this bill second reading with unanimous consent for third reading on the next legislative day.  
Summary of the bill as introduced: Requires an electric utility provider that offers an electric vehicle charging station directly to the public to do so on a non-discriminatory basis under the same fees and conditions offered to private providers of EV charging stations.
